Caylee Anthony
6-10-11
Caylee Anthony Trial: Little Caylee Anthony’s right foot bone and ribs were chewed on by animals. Her trunk was dragged across the woods by animals. Roots were growing through her spine. Her hair was underneath the skull; Video of Caylee picture morphing into a skull with duct tape shown to jury; Medical Examiner, Dr. Jan Garavaglia testified that Caylee’s death was a homicide! If she died in June her body would’ve been skeletonized by August.
Dr Gary Utz, Deputy Chief Medical Examiner was shown pictures of Caylee Anthony’s clothing including her shorts, a tag that said 3-T and letters that had falled off her t-shirt that spelled out “Big Trouble”! He said there was no human tissue on duct tape at any time, mandible held in place by hair and roots. Duct tape was on Caylee’s left and right side.
Dr. John Schultz, professor of Anthropology who consulted with Medical Examiner. Went to crime scene, set up canopy, instructed everyone to be on hands & knees to find bones. Put flags in ground. He said Caylee Anthony’s bones were found in different areas from her skull. Roots were growing through her spine. Animals had been chewing on her bones, including her right foot bone! Animals had dragged the bones from her spinal column across the woods!
Dr. Jan Garavaglia, Chief Medical Examiner. She was shown pictures of roots growing through Caylee Anthony’s hair, Winnie The Pooh blanket, garbage bag etc. Testified she doesn’t know cause of death but manner of death is homicide. She based that conclusion on 3 things that in her experience indicate homicide:
1- Because Caylee Anthony was not reported immediately. The mother waited for 31 days.
2- That the body was hidden.
3- Body had duct tape.
She said there were other objects found with Caylee’s skeleton that could’ve caused death, including: duct tape, plastic bag & chloroform. On cross exam by Cheney Mason she revealed that toxicology tests indicated that there were no drugs found in Caylee’s bones. She didn’t cut open Caylee’s cranium (top of her skull). Testified that animals chewed on bones. When Mason confronted her about what scientific evidence she used to determine death was a homicide, she said that she used the studies of children, that studies are scientific. She said accidental deaths are reported 100% of the time. On redirect from the prosecution, Garavaglia testified that if Caylee died in June, then by August her body would’ve been skeletonized and internal organs completely gone.
Dr. Michael Warren, Anthropologist. He created a video that superimposes a picture of Caylee Anthony’s skull onto a picture of Caylee’s face that he got from the internet. Duct tape moved up and down the video image of the skull. Defense objected but judge allowed video in. Defense accused Warren of creating the video to inflame the jury. They later moved for a mistrial.
Michael Vincent, CSI. He recovered insect evidence from trash in the car. Prosecutor, Linda Drane-Burdick showed him a vial with maggots preserved in a solution.
Robin Maynard. CSI. Documented insect activity at the scene.
Dr John Schultz describes bone activity and carnivore description:
Casey breaks down after testimony about skeletal remains
Dr. Jan Garavaglia confirms tibia came from Caylee Anthony!
Dr Jan Garavaglia cross examined by Cheney Mason!
HERE’S THE TESTIMONY IN MORE DETAIL:
DR. GARY LEE UTZ
Dr. Gary Utz is Deputy Chief Medical Examiner. He was shown pictures of Caylee Anthony’s clothes including:
- Picture of Caylee’s shorts.
- Tag shown with the label from Circo. DA Jeff Ashton asked Dr. Utz, “you shop at Target much”?
- Letters found that belonged to a child’s shirt. The letters spelled out the word, “Big Trouble” The court then zoomed in on photo of Caylee wearing a pink tshirt that says “Big Trouble Comes in Small Packages”.
- Picture of clothing tag with the back that reads 3T (toddlers age 3)
- Picture of blanket shown next to a fabric.
- Dr Gary Utz said he had 2 visits to the recovery seen after photographing pictures.
- Dr. Jan Garavaglia returned on the 11th and she took over the case.
CROSS EXAMINATION by defense lawyer: Cheney Mason
- Cheney Mason asked him what forensic pathology is, then called him a scientist.
-Cheney Mason: “you were aware of the whole hoopla about this case?” Dr Gary Utz: Yes. It was being talked about in the office.
- Mason said Dr. Jan Garavaglia took over because of the high media profile of this case.
- Cheney Mason: there was no duct tape on the left side of the skull? You said some hair mat layed on right side of skull then laying forward.
Gary Utz: No it was not completely encircling it. Duct tape also not on back of skull.
-Duct tape later sent to FBI who determined that no human tissue was on the duct tape at any time.
- No evidence of trauma on remains.
-No closed reductions of fractures in any of bones. That means when a bone fracture heals. No indications of prior injuries.
-Short tag was 24 months.
- Mandible (skeleton’s lower jaw) held in place by hair and roots.
(after decomposition, the mandible is usually loosened from the top of the skull. The mandible is held in place by soft tissue. When soft tissue withers away due to decomposition, the mandible (lower jaw) then separates from the skull. It’s unusual to see a mandible in place after decomposition.
-Mason: When you picked up remains from table, did you hold skull in hands & did mandible fall off?
Gary Utz: No.
Mason: when mandible moved around on examining table, it didn’t fall off?
Utz: No.
- Mason: You do not know the cause and manner of death?
Utz: No…The manner of death was determined by Dr. Garavaglia as homicide.
Redirect: Jeff Ashton
Ashton shows autopsy picture of duct tape on Caylee Anthony’s skull on both left & right side.
DR JOHN SCHULTZ
Associate Professor of Anthropology at University of Central Florida. Specialty is Forensic Anthropology. Dr. John Schultz testified that;
- UCF makes themselves available to law enforcement.
- He was the forensic anthropologist on call for the Medical Examiner. ME.
- Informed on 12-11-08 that skeletal remains found.
-Went to ME’s office, looked in bag & saw skull and duct tape in bag. He tore corners of bag to lay bag flat. He held the skull up so skull could be photographed.
- He said he was surprised that mandible was in place. Mandible normally held together by soft tissue. Hair and roots were holding mandible in place.
- DUCT TAPE NOT HOLDING THE MANDIBLE IN PLACE.
- They set up a canopy over initial area at crime scene. At scene, he instructed everyone to be on their hands and knees, sift out leaf litter. They were laying flags out where items were so they could map them in. Pails placed out there to place items stuck.
- Picture with female CSI under canopy on her hands & knees placing flags.
- He talked about picture of vertebrae (part of the spine)
- ROOTS GROWING THROUGHOUT CAYLEE ANTHONY’S SPINE!
- Vertebrae in separate pieces.
-Bones transported while they were all held together.
-Vertebra bones found at different location than skull!
-Picture of bone fragments shown.
- Picture of lower leg bones (normally attached to pelvis)
- Casey Anthony is now crying at the defense table. She’s resting her head on lawyer, Dorothy Clay Sims’ shoulder.
- CAYLEE ANTHONY’S BONES WERE CHEWED ON BY ANIMALS!
- Picture of hands and finger bones.
- Bones from part of pelvis. One of these found almost completely buried in the muck.
- Picture of skeleton layed out in anatomical order after all bones recovered.
Collected all but 1 tooth, most of spine, ribs, long bones, hands.
- RECOVERED 1 BONE OF THE RIGHT FOOT BUT THERE WAS CARNIVORE ACTIVITY IN THAT PART OF THE SKELETON (that’s why they didn’t get other right foot bone)
EXPLANATION OF DISPERSAL OF BONES ON MAP:
- Area A: they found the skull, bag, arms, hand bones, lower legs, left foot.
- Area B: Shaft for upper arm bone humus.
- Area F southeast: Trunk of body with both femura attached to pelvis, LOWER LEGS DRAGGED TO THIS AREA BY ANIMALS.
- Area D: Only located 1 bone. Right foot exhibited carnivore damage.
- Area E: Hand bone found there.
- Area G: Spinal colum, with vertebrae with ribs attached. Bottom of spinal column separated. Consistant with animal damage. Damage to pelvis.
- Area H: Ribs separated.
- Area I: TOP OF SPINE, FOUND 20 VERTABRAE AS TRUNK BEING DRAGGED THROUGH THE WOODS. THERE WOULD’VE HAD TO BE SOME TISSUE HOLDING BONES TOGETHER WHEN THEY WERE DRAGGED THROUGH WOODS!
- Body deposited in area A relatively intact.
- HIP BONE BURIED IN MUCK! Left Helium.
- When trying to interpret how long skeleton at site & how they were dispersed. Many bones under leaf wall, meaning they were their prior to leaf wall. This bone buried, tells us area was swampy area. When area flooded, action from water, other material suspended in water would’ve been buried. Close to big Palmetto trunk.
- Area F lowest area. When whole trunk brought in there, that was 1 of bone with carnivore damage. Sift goes in there.
- Bones were all dry. No decomposition odor. Slight erosion on bones would take time.
- They were found under leaf litter & root evidence – meaning skeleton there for 6 months!
- Dispersal of bones consistent with animal activity.
- ANIMALS CHEWED ON A COUPLE OF CAYLEE’S RIBS!
CROSS EXAM: Cheney Mason. Dr. John Schultz testified that:
- Bones were x-rayed and no evidence of prior broken bones or fractures.
- Area A was 25-30 feet from edge of road.
- Ronald Murdock did the measurements for the map.
- No scientific evidence as to when dispersment of bones took place.
- DUCT TAPE NOT COVERING THE NOSE.
REDIRECT
- Duct tape was covering mouth area.
- Area F: Bones found were clavicle collar bones, parts of pelvis, femur, shafts, ribs, 1 part of vertebrae.
- Area G: eparation of bottom of spinal column. Couple of ribs.
-Area H: Part of 1 vertabrae, bunch of ribs.
- Area I more ribs. 20 vertabrae
DR JAN GARAVAGLIA
Dr. Jan Garavaglia is the Chief Medical Examiner for Orange & Osceola County since 2004. Prior employment in Texas and Atlanta. She’s a MD, got degree from Missouri in 1982. Specialized in pathology. Dr. Garavaglia testified that:
- She was alerted by chief investigator Steve Hanson to Caylee Anthony’s death.
- She was on her way to airport. Told Dr. Gary Utz to handle it until she got back next day. Told him to called Dr. Schultz, her consultant.
- Caylee Anthony’s hair mat was sent to FBI then it was sent back to her.
- Picture of hair mat, roots that grew through hair. Holes through hair mat from insect activity. She teased out some of hair from hair mat to test for toxicology.
- Picture: Scale next to one of roots on hair mat.
- Picture of blanket. Court zoomed in on photo of blanket and it showed Winnie the Pooh with Piglet on it’s back.
- Pictue of other side of blanket.
- Picture of blanket had plant material growing in it. Vegetative material & roots growing on top of blanket.
- Picture: Root material growing through holes in 2 black plastic bags.
- Picture: canvas laundry bag. It was canvas on outside. Shiny vinyl material on inside. Roots growing into canvas bag.
Roots in bones further out.
- No roots in shorts, shirt was completely disintegrated all left was lettering (Big Trouble), collar, & tag.
- Was hoping for nuclear dna for identification. Sent bone to FBI for DNA identification. Portion that’s missing from right tibia was removed for testing. Picture shown of bone with missing part. FBI lab identified remains as Caylee Marie Anthony.
- Manner of death is based on all information available to the Medical Examiner.
- DR. JAN GARAVAGLIA SAID THE MANNER OF DEATH SHE DETERMINED TO BE WAS HOMICIDE! SHE BASED THAT DECISION ON 3 ITEMS:
1) When child not reported immediately to cops that’s something we look for for foul play
2) Body was hidden. Bodies in closed containers or plastic bags. Red flag for homicide.
3) Duct taped located on lower half of face. That’s seen in homicide
- She testified that the “cause of death” is defined as the injury or disease that initiates the person dying. Caylee Antony’s cause of death is listed as homicide by undetermined means. She doesn’t know the means for which homicide occurred.
- DR GARAVAGLIA TESTIFIED THAT OTHER OBJECTS FOUND WITH THE BODY THAT COULD’VE CAUSED DEATH WERE – DUCT TAPE, PLASTIC BAG & CHLOROFORM.
- When body is that decomposed it’s hard to tell cause of death. No injury to bones.
CROSS EXAM – CHENEY MASON
- Cheney Mason: You live in Orlando & were aware of media attention.
- Dr. Garavaglia admits she was told of chloroform.
- She brought in a toxicologist, Dr. Goldberger. She sent to him bone from left femur to look for chloroform and other volatile chemicals like alcohol etc When he was done – results were negative for each and every one. NO DRUGS WERE FOUND IN CAYLEE ANTHONY’S BONES!
- Cheney Mason: Did Dr. Werner Spitz, defense expert, come down to participate in autopsy?
Dr. Garavaglia said no. She was told by office manager that lawyer, Jose Baez wanted to bring in outside person to watch autopsy. It was against policy.
- Dr. Goldberger is a PHd not a medical doctor.
- He tested bone for volitales, hair & soil that fell out of hair. Scrapings from bone marrow, washings from cranial cavity for prescription drugs or illicit drugs. ALSO TESTED FOR XANAX. — all came back negative!
DR JAN GARAVAGLIA TESTIFIED THAT SHE DID NOT CUT OPEN CAYLEE’S CRANIUM. (TOP OF HER SKULL) (this is significant because later on when the defense puts on their case, their medical examiner did cut open Caylee Anthony’s cranium and I think they found leaves or roots on one side of the skull, indicating that the body had been moved! I heard that on the Geraldo Rivera show 6-11-08)
- No trauma to bones except animals chewing on the bones.
- Cheney Mason: You decided to call it a homicide by indeterminate means! –
-Dr. Jan Garavaglia: Homicide is only logical, scientific conclusion.
-Cheney Mason: “what is the scientific information on homicide???
-Dr Jan Garavaglia:
“systematical observational studies, our study of children, studies are scientific. We look at accidental drownings. In 100% of cases, EMS is called. ** “By my experience and by what is known about the way homicides occur, I felt that by the preponderance of evidence, that there was no logical conclusion could be found by not reporting a child for 30… who has a legal, moral and ethical obligation to care for a child and reporting that child missing. The fact that it’s tossed in a field to rot in bags is a clear indication that the body was trying to be hidden. Even it being put in a big is a very big red flag for homicide, never seen in accidental death in a child. And the fact that there’s duct tape anywhere attached to that child’s face is to me indication of a homicide.”
- Cheney Mason: What’s scientific about your observations?
– Dr. Garavaglia: Accident deaths reported 100% of time.
- Cheney Mason: What if person found an obviously drowned body?
- Dr Garavaglia: They always call 911 no matter how stiff that body is. On the chance the child could be saved.
- Cheney Mason: Cause of death you don’t know. Manner of death you think is homicide!
- Dr. Jan Garavaglia: I felt the manner of death is defensible by systematic studies of how homicides and accidental deaths occur.
- Duct tape was in vicinity of lower mandible.
REDIRECT – Jeff Ashton
- Dr. Garavaglia said she kept the body in the exact condition as when she received it for defense autopsy.
- We wouldn’t expect to find toxicology in bones even if it was present at time of death.
- IF CAYLEE DIED IN JUNE HER BODY WOULD’VE BEEN SKELETONIZED BY AUGUST. HER INTERNAL ORGANS WOULD BE COMPLETELY GONE!
That was the end of Dr. Jan Garavaglia’s testimony. As she got off the witness stand, she had a big smile on her face. She was positively beaming, grinning from ear to ear like the Cheshire cat!
Looking at this from a neutral perspective, today was suppose to be a strong day for the defense. The Medical Examiner has no scientific cause of death. Only that they believe the manner of death is homicide – but they don’t know how! It’s harder to prove murder without a cause of death.
In my opinion, Cheney Mason did a pi$$ poor job! Now, that statement is not coming from a place of hostility. Most people that criticize the defense criticize them for the sole reason that they don’t like the defense lawyers simply because they’re representing Tot Mom. Not me. I understand that defense lawyers are just doing their jobs. Under the Constitution, everyone is entitled to a defense by competent lawyers. If you say you believe in the Constitution, that everyone is entitled to a defense, then you shouldn’t have a problem with defense lawyers doing their jobs. So, I don’t hate the defense lawyers, if anything, I actually respect Cheney Mason for his past notable victories in court. That being said, let me continue:
Cheney Mason did a pi$$ poor job! He seems to be a paper tiger rather than a real one.
He let that Garavaglia woman get away with everything under the sun!
First of all, Dr. Jan Garavaglia has her own tv show on the Discovery Channel. As a defense lawyer, Cheney Mason could’ve taken advantage of the fact that Garavaglia has her own tv show and pointed out to the jury that maybe she’s going along with popular opinion to get more ratings for her tv show! He could’ve accused her of having ulterior motives. He didn’t take advantage of that.
Secondly, Cheney Mason also let her go on and make an impassioned speech about why she thinks Caylee’s death is a homicide. She gave 3 reasons why she listed the cause of death as murder. Mason didn’t do a good job of attacking her 3 reasons. Dr. Garavaglia gave the first reason as Caylee not being reported missing for 31 days. Cheney Mason said nothing. He could’ve said, Caylee wasn’t reported missing because SHE WAS NEVER MISSING – she drowned in the pool (according to the defense). He could’ve said that but didn’t.
The second reason she gave for listing the death as murder is that the body was hidden. Cheney Mason could’ve asked her, “how do you know Casey hid her”? “How do you know that George Anthony or Roy Kronk didn’t hide her there?” He didn’t. Instead he let her go on with her impassioned speech.
The third reason Dr. Garavaglia gave for listing the death as a homicide was that there was duct tape on the lower half of the face. Cheney Mason could’ve asked her, “Do you know for a fact that Casey Anthony put that duct tape on her face”? “How do you know that it wasn’t George Anthony who put it there”?
Lastly, Dr. Jan Garavaglia comes across as extremely likable. I’ve never seen her tv show, saw her for the first time in court today – and I liked her. I don’t know why I like her, I just do. And believe me, for me that’s big, because I don’t like anyone! Dr. G. just comes across as likable. With people like that, you have to employ character assassination. Maybe the gross out factor. The Yuck factor. The jury just sees her as this nice lady testifying on the witness stand. But what is she really? What does she do for a living? Dr Jan Garavaglia cuts open dead bodies for a living! She takes a saw and will saw open your loved ones chest! She scoops out eyeballs, cuts open skulls, dips her hand in dead people’s blood. Cheney Mason could’ve used that info to paint her in an unfavorable light to the jury. He could’ve said something like, “Dr. Garavaglia, as part of your job as the Medical Examiner, isn’t it true that you saw open dead people all day long? That you take your hands and scoop out dead people’s hearts and lungs? That you play with blood from corpses all day”? Do you enjoy being around dead people? He could’ve painted her out to be the Bride of Frankenstein to change the way the jury sees her. So they don’t see her as this nice, educated lady on the witness stand, they’ll see her as a ghoul. But Mason didn’t.
I’m not a lawyer, but these are all examples of things Cheney Mason could’ve done but didn’t. He didn’t accuse her of ulterior motives (tv show). Mason let her make her impassioned speech about the 3 reasons she thought Caylee’s death was a homicide – and he didn’t attack the reasons. And third he didn’t try to change the way the jury sees her. They probably see her as an educated, nice lady instead of the Bride Of Frankenstein who’s around dead people all day.
Let me point out that I’m making this critique of Cheney Mason’s performance as a neutral party.
After the testimony of Dr. Jan Garavaglia, Judge Belvin Perry sent the jury out of the room. The court began viewing a videotape that only appeared on the attorney’s and judge’s computer screens. The audience was not able to see it. Casey Anthony, looking at her lawyer’s screen playing the tape, appeared angry.
As it turns out, Dr. Michael Warren, an anthropologist created for the prosecution, A CD THAT SHOWED CAYLEE’S SMILING FACE SUPERIMPOSED ON PICTURE OF CAYLEE’S SKULL!
- DA Jeff Ashton says reason for photo is to show duct tape matches to skull.
- “this disgusting superimposition is nothing but a fantasy that’s not supported by anying that cant be testified to.” The proper way of arguing would be someone tesiying as to measurements of child, measurements of duct tape…. Probative value outweightd by prejudice. If 403 ever created it was created for this situation.
- Jose Baez: There were 3 pieces of duct tape – 1 was found 9 feet away!
Judge Perry decided that before he considers whether or not the jury should see this video of Caylee’s face morphing into a skull with duct tape – he wanted to question the doctor who created it first. That’s called a proffer. Questioning done outside of the jury’s presence to determine if evidence should be allowed in.
DR. MICHAEL WARREN – PROFFER
Dr. Michael Warren is a Forensic anthropologist. Asst Professor at Univ of Florida. He worked with Dr. Schultz and examined skull & other bones.
- He created the video to establish if duct tape was weapon that caused death.
_ The superimposition was created by taking a picture of Caylee’s skull and tape and then he got picture of Caylee off internet.
- He testified that the superimposition was necessary because they have photographic scales. Sizes of skull & tape have scales. Face has no scales.
- BY USING THE SKULL, YOU’RE MAKING SURE THE FACE IS ONE TO ONE WITH THE TAPE. Without superimposition it’s impossible to determine the distance between duct tape and Caylee’s chin. There was no other way to demonstrate that duct tape could cover both nose and mouth.
Cross Exam – Jose Baez
- Jose Baez: Pointed out that there were talks of duct tape being murder weapon between him (Dr. Michael Warren), Dr. Jan Garavaglia and DA Jeff Ashton. Discussion took place early on.
- He made suggestion of superimposition while considering prosecution.
Baez: You never saw where duct tape was positioned by hair other than photograph? Pictures of ones attach to hair mat, not skull. Hair mat underneath Caylee’s skull. There’s no scale on her face in that picture.
- Baez: You don’t even know how old Caylee was in that picture. This was just a picture you took off the internet…..She could’ve been much larger at time of death than in that picture.
- Dr. Michael Warren told Judge: Purpose of tape to demonstrate that width of tape could cover both nose and mouth…….By overlaying images, size of skull next to size of face is real.
Judge Perry rules the superimposed picture could be allowed as evidence.
DR. MICHAEL WARREN (jury testimony)
Associate Professor at University of Florida, & is director at forensic anthropology human identification lab. Dr Michael Warren testified that:
- On 12-15-08 he was contacted by Dr. Jan Garavaglia & Dr. John Schultz to examine remains.
- Said mandible was still on skull. It’s noteworthy because nothing to hold jaw in place once soft tissue decomposes.
- Said tape had moved. He attempted to discover whether single piece of duct tape would’ve been sufficient to cover nose and mouth. Tells jury he used video superimposition.
- Video published, audience looks up to courtroom monitors.
- He said the reason for tape being moved up & down the video shown is because we don’t know where tape was.
- Single piece of tape would’ve been sufficient to cover nose & mouth, making breathing impossible.
CROSS EXAM – Jose Baez.
- Jose Baez: You never saw duct tape while attached to hair mat?
Dr Michael Warren: No….p
- Jose Baez: The photo you got of Caylee was from the internet. You don’t know how old Caylee was when the picture was taken.
- Baez: When you say it’s possible that ductp could’ve cover her nose and mouth it’s also possible that it didn’t?
- Michael Warren: yes.
- Baez: You don’t know if duct tape had anything to do with disposal or death?
- Dr. Warren, No.
- Jose Baez: Caylee was found on the surface (ground). Above surface was hair mat. Above that the skull. When person is alive, hair is on top of head. Duct tape found across front attached to her hair.
- On sketch pad facing the jury, Jose Baez drew, duct tape on hair mat on bottom of skull!
- Jose Baez: Caylee was at one time in 3 bags inside canvas bag. Canvas bag had round cylinder shape. …..You have no idea of whether duct tape used to wrap Caylee’s remains, you have no idea place of that duct tape?
- Dr. Warren: It was over mandible.
- Baez: That’s because it was attached to mat of hair under the skull.
- Baez showed Michael Warren a picture of hair mat on floor, slightly above it was mandible, in order for hair mat to be under skull, on floor, something had to have made it roll there or put hair in that direction. Duct tape made it’s way there with hair in that direction. Michael Warren said yes.
- Baez: Video you showed of duct tape was graphic – was it to appeal to jury’s emotions when you asked Mr. Ashton to do that? (Objection)
- Dr. Michael Warren was not aware that other piece of duct tape found 9 feet away.
- Acknowledges that video was just 1 possibility of Caylee’s death.
REDIRECT
– duct tape placed on Caylee prior to decomposition. Based on position mandible found. Mandible always becomes loose but for duct tape.
- Jeff Ashton: Picture showed not under mandible but posterior. Hair is attached to soft tissue. When that decomposes, hair falls down.
CROSS EXAM: Jose Baez
- Jose Baez: Significant root growth under mandible. Roots could also contribute to keeping mandible in place as in photo. Dr Michael Warren acknowledged that it’s possible.
REDIRECT
- Jeff Ashton: Does active decomposition prohibit plant growth? Michael Warren: No.
- Jeff Ashton: Before roots can hold mandible in place, it would have to fall off. So only thing holding mandible together is duct tape.
MICHAEL VINCENT
CSI with Orange County Sheriff. Recovered insect evidence from trash in car.
- DA Linda Drane-Burdick showed him vial of maggots in preserved solution.
- He got it from trash and sent it to Dr. Neil Haskell.
- shown a vial of “pupae?” late stage of their life cycle.
Cross Exam – Jose Baez
- Baez: Items taken from garbage bag. Collected on 8-28. You processed trunk, inspecting it. Insects in later stages. Entymologist can look at stage and determine life cycle of maggot. ….You didn’t see any insect activity in car trunk on 7-16-08? Michael Vincent said, No.
- Baez: All you saw was insect activity in garbage bag?
Michael Vincent: yes.
ROBIN MAYNARD
In December 2008 she was CSI. Assisted in recovery of skeleton. Documented insect activity at scene. Collected over several days.
- DA Linda Drane-Burdick showed her pupae (insect evidence).
- She relayed info to other CSI. Consulted with Dr. Neil Haskell.
Cross exam – Jose Baez
- Baez: Multiple people collected entymological evidence. All kinds of items found in lanes – beer bottles , tires, etc. ….Elementary school to the east of area.
At the end of the day, Jose Baez moves for mistrial based upon allowance of video superimposition. He said it served only 1 purpose and that was to inflame the jury. Witness testified he could’ve testified without video. The judge denied the motion then threatened the defense team that if they file for another mistrial, he’ll reserve his ruling on the mistrial until after the verdict is reached.
